Q Jack, Jill and Dave are students at Foothill College. Dave and Jill were former lovers until Jill decided to drop Dave and go out with Jack instead. Dave was upset and believed Jack was the reason for the breakup. Dave thought that if Jack were no longer around, Jill would come back to him. Then one day, while Dave was driving his car on campus, Dave sees Jack and Jill in front of him holding hands as they were walking on the sidewalk. Dave immediately drives onto the sidewalk, scattering the people in front of him and attempts to run over Jack with his car. Jack turns around to see what was causing the commotion behind him, and he sees Dave like a demon in a car coming towards him. Jack immediately jumps over a concrete barrier to avoid being hit by Dave. Dave’s car strikes Jill, who never saw the car coming and didn’t know what hit her. The car finally stops when it strikes the concrete barrier. Who can sue whom and under what legal theories and win? Please use IRAC in your case analysis for each legal theory.
